End-of-service indemnity in Kuwait (2026)

End-of-service indemnity in Kuwait's private sector is governed by Articles 51–53 of Labour Law No. 6 of 2010. The rate depends on how pay is calculated; this calculator shows the monthly-paid worker's rate:

How it is calculated (monthly-paid)

  • First 5 years: 15 days' wage for each year.
  • After 5 years: a full month's wage for each year.

The total may not exceed 1.5 years' (18 months') wage. (Daily-, weekly- or piece-paid workers accrue at 10 then 15 days, with a separate one-year cap.)

Resignation (indefinite-term contracts)

  • Under 3 years: nothing.
  • 3 to 5 years: one-half.
  • 5 to 10 years: two-thirds.
  • 10 years or more: the full amount.

When the employer ends the contract (without gross misconduct), the full indemnity is paid regardless of tenure.

Which wage is used?

It is based on your last wage. Article 55 defines "wage" broadly to include regularly paid allowances, so the base is more than basic salary; computing on basic only is common in practice but not what the law prescribes — check your contract.

Calculation Methodology

Wage used in the calculation

The calculator uses the monthly salary you enter as the calculation base. In some systems this may be basic wage only, while in others it may include actual wage or fixed allowances; enter the wage basis that matches your country and contract.

Service period conversion

The calculator converts years and months of service into a proportional period, then applies the days or months owed per year according to the country and termination reason.

Reason employment ended

The result changes for resignation, employer termination, or contract end. Some laws reduce or deny gratuity for certain service periods. Check the legal reference on the page for final treatment.

Practical Examples

Resignation after 6 years — 1,200 KWD salary

Khalid earned a basic salary of 1,200 KWD and resigned after 6 years. First 5 years: 5 × (1,200 ÷ 30) × 15 = 3,000 KWD Year 6: 1 × (1,200 ÷ 30) × 30 = 1,200 KWD Full gratuity = 4,200 KWD Resignation modifier (5–10 years) = ⅔ Entitlement = 4,200 × ⅔ = 2,800 KWD

Termination after 12 years — 800 KWD salary

Noura earned a basic salary of 800 KWD and was terminated after 12 years. First 5 years: 5 × (800 ÷ 30) × 15 = 2,000 KWD Next 7 years: 7 × (800 ÷ 30) × 30 = 5,600 KWD Gratuity = 7,600 KWD Cap (1.5 years) = 14,400 KWD → not exceeded Entitlement = 7,600 KWD

Frequently Asked Questions

What is the difference in gratuity between monthly and daily workers in Kuwait?
Monthly workers receive 15 days' pay per year for the first 5 years and 1 month per year after, capped at 1.5 years' salary. Daily, weekly, hourly, or piecework workers receive 10 days per year for the first 5 years and 15 days after, capped at 1 year's salary.
What is the maximum gratuity cap in Kuwait?
The cap depends on the payment type: 1.5 years' salary for monthly-paid workers, and 1 year's salary for daily, weekly, hourly, or piecework-paid workers.
Is gratuity paid upon resignation in Kuwait?
Yes, but at reduced rates per Article 53: under 3 years receives nothing, 3-5 years receives half, 5-10 years receives two-thirds, and over 10 years receives the full indemnity.
Does the gratuity include allowances in Kuwait?
Gratuity is calculated based on the last wage, which includes all periodic payments. It is advisable to review the employment contract to determine the exact wage components used in the calculation.
Are domestic workers entitled to end of service gratuity in Kuwait?
Domestic workers are governed by a separate law (Law No. 68 of 2015), not the Labor Law No. 6/2010. Their gratuity entitlements depend on the specific terms of their employment contract.
Can the employer deduct amounts from the gratuity?
Yes. The employer may deduct any amounts owed by the worker from the end of service indemnity, such as advances or proven damages.
